On Tuesday 3 December 2018, two days before the answering affidavits of its clients were due, the Applicant’s attorneys of record received a letter from State Attorney informing them that his clients’ answering affidavits would not be served on or before 5 December 2018 and asking for an indulgence until 31 January 2019 to furnish these answering affidavits.
The Applicant’s attorneys of record discussed the matter with the Applicant and Counsel, whereafter it was decided that, whilst the Applicant did not in principle oppose granting such indulgence, he could not unilaterally override the directive of the Honourable Deputy Judge President of the Pretoria High Court, which was issued on 11 September 2018. As s consequence, a letter was drafted to the State Attorney, advising him to approach the Honourable Deputy Judge President of the Pretoria High Court.
